The Compliance Officer will support the Compliance Manager to oversee ethics, compliance and accountability issues across the Afghanistan Country Program.  

The core purpose of the role is to support and promote an ethical and compliant work environment within the Afghanistan Country Program; through proactive prevention initiatives, raising awareness and promoting behaviors consistent with Emergency Code of Ethics and Policies, as well as applicable laws; and providing timely review of alleged wrongdoing inconsistent with EMERGENCY’s values and policies under the supervision of the Compliance Manager. 

EMERGENCY has zero-tolerance standpoint on sexual misconducts and other criminal or unethical behaviors that may cause harm to the people in need and their rights, as well as to the co-workers and to the reputation of the Organisation as a whole.  

For the purpose of proper selection for this role, EMERGENCY will require the submission of criminal background police check and will conduct in-depth review of the profile and references of the first best and second best candidates.

The role will have a range of responsibilities, as it follows. 

Major Responsibilities 

Prevention: Create a safe and compliant environment 

  • Inspire a strong culture of ethics, accountability and compliance by providing regular periodic trainings, capacity building and advice to staff and partners as needed; 
  • Coordinate specific auxiliary roles for safeguarding at Country Program, where relevant;  
  • Following indications of the Compliance Manager, review and report on the extent to which internal policies and procedures are complied with, including conducting walk-throughs and tests that assess whether systems and controls are operating as per policies, procedures, and donor regulations; 
  • Review and report on the adequacy and effectiveness of EMERGENCY’s systems and internal policies and procedures, assessing the extent to which these controls offer adequate protection against misconducts of all kinds; 
  • Support Country Program in integrating accountability measures, as required by donors or the EMERGNCY standards and under the guidance of Compliance Manager, 
  • Provide follow-up support on the timely implementation of audit findings and action plans in conjunction with key country program staff, 
  • Support records management and archiving processes to assist with the proper filing of documentation. 

Strengthening Reporting of wrongdoing and Accountability 

  • Ensure staff are informed of EMERGENCY’s Whistleblowing Policy and Complaint Reporting Mechanism and help implement the policies as directed by the Compliance Manager and upon the standards set in the same policy; 
  • Promote a culture of reporting on ethics and compliance concerns, providing appropriate feedback to staff, partners, and complainants, working closely to ensure support and follow-up is provided. 

 Investigations 

  • As prescribed in the Whistleblowing and Complaint Reporting Mechanism Policy, ensure swift, efficient and structured investigation on relevant misconduct allegations that fall under the competence of Field Level or support for those falling under the Main Office Level;. 
  • Maintain, in the required format, an up-to-date tracker of cases and recommendations; 
  • Follow up on recommendations to deploy at Field Level, ensuring collaboration with the relevant departments in the Program Country. 

Other 

  • Stay informed of EMERGENCY’s procedures and policies in relation to Administration, Supply Chain, Finance, HR, Security and Programs as set out in relevant EMERGENCY manuals and guidelines; 
  • Work in collaboration with each and all relevant departments in the Country Program, to clear issues communicated following compliance spot checks or audits; 
  • On-going alignment with Compliance Manager; 
  • Perform other tasks as requested by the Compliance Manager as required. 

Desired profile 

  • Bachelor’s degree (preferably also Master’s degree) in Law, International Law, International Cooperation or International Relations; 
  • Proficient in English (knowledge of Farsi is an asset); 
  • Previous experiences in the humanitarian field, 
  • Practical knowledge of humanitarian standards, principles, Do No Harm, AAP; 
  • Sound knowledge of main donors requirements and standards for Policy, Compliance and Ethics; 
  • Experience in conducting surveys; 
  • Experience in conducting administrative investigations; 
  • Experience in supporting in auditing process; 
  • Ability to connect and create collaborative environment with multidisciplinary teams; 
  • Strong motivation for ethical and compliant work
